The TN visa is a nonimmigrant work authorization available to Canadian and Mexican citizens in designated professional occupations under the USMCA. There is no annual cap, no lottery, and status is granted for up to three years with unlimited renewals. Canadian citizens may apply directly at a U.S. port of entry; Mexican citizens apply through consular processing.
TN Visa Overview
The TN nonimmigrant classification is available to Canadian and Mexican citizens under the United States-Mexico-Canada Agreement (USMCA). It covers a defined list of professional occupations including engineers, scientists, accountants, management consultants, and computer systems analysts, among others.
TN status is granted for up to three years at a time and can be renewed indefinitely. There is no annual numerical cap on TN visas, which provides a significant advantage over the cap-subject H-1B process.
Canadian Citizens
Eligible Canadian citizens may apply for TN classification directly at a U.S. port of entry with the required documentation. This includes a letter from the U.S. employer describing the professional position, evidence that the position qualifies under a USMCA profession, and proof of Canadian citizenship and the required qualifications.
The port-of-entry application process for Canadian citizens is generally more streamlined than the petition-based process. However, thorough documentation is essential — inadequate preparation can result in denial at the border, which can create complications for future applications.
Mexican Citizens
Mexican citizens seeking TN classification must obtain a TN visa stamp at a U.S. consulate before entering the United States. This requires filing a complete application with the consulate, including the employer support letter and qualifying documentation.
The consular process for Mexican nationals involves additional steps compared to the Canadian process. Careful preparation of the application package and supporting evidence is important for a successful outcome.
Key Considerations
The TN classification does not formally recognize dual intent — the intent to remain in the U.S. permanently and temporarily at the same time. This can affect long-term green card planning, as officers may scrutinize TN renewal applications if there are indicators of an intent to remain permanently. Strategic planning is important for professionals considering a transition from TN status to permanent residence.
The position must qualify under a specific USMCA professional category, and the applicant must possess the required credentials for that category. Not all professional roles fit neatly within the TN categories, so a careful analysis of job duties and qualifications is an important first step.
